Terms and Conditions

These Terms and Conditions apply to all Towncast services. By purchasing or subscribing, you agree to these terms.
 
1. Definitions
 
“Towncast” refers to the trading name Towncast, operated by Shire Web Design LTD.

“We”, “us”, and “our” refer to Shire Web Design LTD.
“You” refers to the client or customer purchasing Towncast services.
 
2. Services
 
Towncast provides productised website services, including:
• One-page websites
• Contact form or booking system setup
• Website hosting
• Platform configuration
• Ongoing website upkeep under subscription
 
All services are delivered using predefined templates and systems. Towncast does not provide bespoke design, development, or custom features unless agreed separately in writing.
 
3. Setup Fees
 
Setup fees are one-time payments covering the configuration and deployment of your website and systems.
Once work has started, setup fees are non-refundable.
 
4. Monthly Subscription and Hosting
 
Your monthly subscription includes:
 
• Website hosting
• Platform updates and security
• System maintenance
• Minor content changes
 
Website hosting is provided through Wix Studio, a third-party platform. While we manage and maintain your website as part of your subscription, the underlying hosting infrastructure, servers, and platform security are operated by Wix.
 
We are not responsible for outages, downtime, data loss, security breaches, or technical issues caused by Wix Studio or any third-party services used as part of the hosting environment. Any such matters are subject to the terms, conditions, and service levels of the hosting provider.
 
5. Billing and Payment Timing
 
• Subscriptions are billed monthly
• Payment is taken 3 days before the subscription renewal date
• You are responsible for ensuring payment details remain up to date
 
If payment fails or is not received, the steps below apply.
 
6. Non-Payment, Suspension, and Unpublishing
 
If payment is not received:
• You will have 7 days after the due date to settle the outstanding balance
• During this period, your website may remain live at our discretion
If payment has not been received after 7 days:
• We reserve the right to unpublish your website
• Hosting services will be stopped
• We will cease paying hosting costs on your behalf
• Access to upkeep and support will be suspended
Your website can be republished once payment is brought up to date.
 
7. Hosting and Domains
 
Hosting is included in your monthly subscription and is managed by us.
Your domain remains fully owned by you at all times. Domain registration and renewal costs are your responsibility unless explicitly stated otherwise.
If your subscription ends or is cancelled:
• Hosting will be discontinued
• Your website may be unpublished
• Your data remains yours
 
Website hosting is provided through Wix Studio, a third-party platform. While we manage and maintain your website as part of your subscription, the underlying hosting infrastructure, servers, and platform security are operated by Wix.

8. Changes and Support Scope
 
Minor changes include:
• Small text edits
• Image swaps
• Updating contact details
The following are not included:
• New pages
• Layout or design changes
• Feature additions
• Redesigns
Requests outside scope may be quoted separately or declined.
 
9. Cancellations
 
Subscriptions may be cancelled in line with any minimum term agreed at purchase.
No refunds are provided for partial months.
Once cancelled:
• Hosting and upkeep will end
• The website may be unpublished
 
10. Client Responsibilities
 
You are responsible for:
• Providing accurate information
• Ensuring you have rights to any content supplied
• Complying with applicable laws and regulations
We are not responsible for content accuracy, legal compliance, or business outcomes.

We do not guarantee specific business results, lead volumes, conversions, rankings, revenue, or performance outcomes. Any examples or references to performance are illustrative only and should not be relied upon as guarantees.
 
Your website is a tool to support your business, but overall success depends on factors outside our control.
 
11. Intellectual Property
All templates, systems, and underlying website structures remain the intellectual property of Shire Web Design LTD.
 
You are granted the right to use the website while your subscription is active and paid.
 
12. Limitation of Liability
 
Services are provided on an “as is” basis.
We are not liable for:
• Loss of profits
• Loss of business
• Indirect or consequential losses
Our total liability is limited to the amount you have paid to us in the previous 12 months.
 
While we take reasonable steps to configure websites securely and follow best practices, we cannot guarantee uninterrupted service or absolute security. Responsibility for server-level security, data storage, backups, and infrastructure protection rests with the third-party platform provider.
 
We shall not be liable for any loss of data, security incidents, hacking, malware, or unauthorised access resulting from platform-level issues beyond our reasonable control.

In all circumstances, our total liability shall be limited to the total amount paid by you for the service during the twelve months preceding any claim.

13. Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to events beyond our reasonable control, including but not limited to platform outages, internet failures, cyber incidents, acts of God, government actions, or third-party service disruptions.
 
14. Governing Law
 
These Terms and Conditions are governed by the laws of England and Wales.
Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
